Miscellaneous other changes to charity law

Although the Charities Act 2022 received Royal Assent on 24 February 2022, its provisions are effective only when implemented by means of Regulations made by the Secretary of State. 

Regulations implementing some of the Act’s provisions (as noted below and also on the other pages) above) were made on 31 October 2022 and 14 June 2023. Once further implementation dates are known, this page will be updated as necessary.

The 2022 Act provides for a number of changes to charity law in addition to those explained in the above pages, including the following changes. (For details of these and other changes, please see the Act here.)

• effective since 14 June 2023, the Act confers enhanced powers on the Charity Commission to require a charity to change, or stop using, an unsuitable formal name and/or working name that it uses. For details, see Sections 25 to 28 of the Act here.

• provisions in the Act conferring powers on the Commission to resolve uncertainties or defects in the appointment or election of charity trustees. It is expected that these changes will be implemented but no implementation date is yet known.

• provisions in the Act for gifts to a charity which has merged with another charity to take effect as a gift to the new charity. It is expected that these changes will be implemented but no implementation date is yet known.
