Charity Licence and Tenancy at Will Documents

These Charity Licence and Tenancy at Will Documents can be used when a charity is only going to occupy the premises for a short time (say, less than 6 months) or if the parties are still negotiating lease terms, but the charity needs to occupy the premises immediately. They have been professionally drafted for use by landlords granting licences and tenancies at will to charities in respect of office and shop premises and land for a fete or other short term event or activity.  

Care should be taken that a licence cannot be interpreted as a lease and there is guidance outlining the different types of arrangements - lease,  licence or tenancy at will - that should be considered before entering an agreement for the occupation of premises.  If a charity has exclusive possession of the premises then such an arrangement is a lease whether or not the parties call it a lease or licence.   A court might decide that the licensee is really a tenant who has security of tenure. This would mean the charity would have the right to remain at the end of the term of the lease.  These licences do not provide for the occupier to have exclusive possession.
