These Guidance Notes - Right to Work in the UK Checks can assist employers in complying with their obligation to check and record employees’ immigration and working status.

All UK employers are legally required to check and record the immigration status of every prospective employee/employee, in order to verify their right to work in the UK. The type of right to work checks required will depend on factors such as the individual’s nationality and residence status.

 A British or Irish citizen can demonstrate their right to work in the UK with one of the following:

  • a British passport, birth or adoption certificate
  • an Irish passport or passport card, birth or adoption certificate
  • a certificate of registration or naturalisation as a Brtish citizen.

An individual who is not a British or Irish can prove their right to work with:

  • a share code or
  • eligible immigration documents.

The Home Office’s Right to Work checklist gives details of which Right to Work documents must be provided by individuals to employers, and how employers should carry out document checks in order to meet the required standards for compliance.

Employers must either:

• Carry our a manual right to work check, by physically meeting with the employee to check and copy their original documentation; or

• Appoint an ‘identification service provider' (IDSP) to check the passport on their behalf. A list of certified IDSPs can be found on the gov.uk site.
