Employment, Contractors' and Workers' Privacy Notices

Under the UK's data protection legislation, consisting primarily of the UK GDPR and the Data Protection Act 2018, data subjects (in this context, employees, contractors, and so forth) must be furnished with a range of information. This privacy information is best presented in a document known as a Privacy Notice, Privacy Policy, Privacy Statement, or similar. 

Employment privacy notices are essential for compliance with the above legislation and help employees understand how their personal data is handled within the employment context and what rights they have in relation to their data.

The selection of notices below provides for use in different contexts within HR and the cycle of employment and other forms of engagement:

Job Application Privacy Notice

This notice should be used from the start of the recruitment process, and informs applicants how their personal data will be used throughout. It sets out the types of information that will be collected and how it will be collected and used (including information provided by the applicant and, optionally, that gathered from third parties such as references). The majority of the document sets out information common to all privacy notices.

Interviewee Privacy Notice

This notice duplicates the Job Application Privacy Notice above, and is likewise designed for use at the start of the recruitment process. Both documents are included to cover the recruitment cycle in full, however only one of the two will be required for this stage in the employment or engagement.

Employees and Contractors Privacy Notice

This notice should be used once an employee or contractor has been engaged and sets out how employees’ and contractors’ personal data will be used during their employment or engagement. Again, the types of information that will be collected and how they will be collected are set out, with a greater and more varied amount of data than in the document above (for example, terms of employment, disciplinary matters, details of leave, CCTV footage, and more sensitive information such as medical conditions and union membership). All common privacy notice information follows the tailored sections at the top of the document.

Workers Privacy Notice

Workers, unlike employees or contractors, are free to accept or reject any offer of work made to them. From a data protection perspective, the nature of this relationship is reflected in the types and amount of personal data involved. This notice is tailored specifically for workers (and thus not suitable for employees or contractors). A smaller (but still significant) amount of data is set out in this notice, followed by the same standard provisions common to the other notices described above.
