A  Tenancy Agreement Guarantee and Indemnity is a legal agreement where a guarantor agrees to cover the tenant's legal obligations under a tenancy agreement.  Landlords are likely to ask for a Guarantor if the Tenant does not have a satisfactory credit history or references. The proposed form of AST agreement should be annexed to the Guarantee so that all parties know what the extent of the Guarantor’s liability is.

Why Do  I Need This Template?

As a landlord this document acts as a protection in the event the tenant fails to pay rent, or breaches the terms of the tenancy.  

Under the guarantee, the guarantor agrees to:

  • Pay rent and other sums due if the tenant fails to do so
  • Make good losses, damages, and costs resulting from tenant breaches
  • Indemnify the landlord independently of other obligations
  • Ensure their estate covers obligations if the guarantor dies in the tenancy 

Under the Tenant Fees Act 2019 landlords and/or letting agents in England are prohibited from charging any fees associated with requesting a guarantor to a tenancy caught by these acts (this includes referencing fees and administration fees).
